1. About the Website

This Website showcases and offers for sale original contemporary artworks created by Jelena Kundich, together with bespoke commissioned artworks and related services.
All information presented on this Website is provided in good faith. We reserve the right to update, modify or discontinue any part of the Website without prior notice.

2. Original Artwork

Every painting offered through this Website is an original, handcrafted artwork.
Unless expressly stated otherwise:

• every artwork is unique;

• no identical copy will be created;

• slight variations in texture, brushwork and natural materials are part of the artistic process and should not be considered defects.

The purchase of an artwork transfers ownership of the physical artwork only.
Copyright and all intellectual property rights remain the exclusive property of the artist.

3. Commissioned Artwork

Commissioned artworks are created specifically for each individual client.
Before work begins, the following details are agreed together:

• dimensions;

• colour palette;

• overall composition;

• delivery method;

• estimated completion schedule.

Because commissioned paintings are created exclusively for one client, they cannot be cancelled, returned or exchanged once work has commenced.
Minor artistic variations are an inherent part of the creative process and do not constitute defects or grounds for cancellation.

4. Product Information

Every effort is made to accurately represent each artwork.
However, colours may appear slightly different depending on:

• monitor settings;

• mobile device displays;

• screen calibration;

• lighting conditions during photography;

• camera characteristics.

Measurements shown on the Website are approximate and may vary slightly due to the handcrafted nature of each artwork.

5. Pricing

Unless otherwise stated, all prices displayed on this Website are shown in EUR (€).
Prices may be updated at any time without prior notice.
The price applicable to your purchase is the price displayed at the time your order is confirmed.

6. Orders

An order is considered accepted only after payment has been successfully received and confirmation has been issued.
We reserve the right to decline or cancel an order in exceptional circumstances, including but not limited to:

• pricing errors;

• technical errors;

• payment verification issues;

• artwork no longer available.

Should this occur, any payment received will be refunded in full.

7. Payment

Payments are processed through secure third-party payment providers.
We do not store or have access to your payment card information.

8. Shipping & Delivery

Shipping information, packaging methods and delivery estimates are described in our Shipping & Returns Policy.
Depending on the artwork, destination and shipping requirements, paintings may be delivered:

• stretched on their original wooden stretcher and ready to hang;

• or professionally rolled inside a protective shipping tube.

The safest shipping method will always be selected for each individual artwork.

9. Customs Duties & Import Taxes

Orders delivered outside the European Union may be subject to customs duties, import VAT, local taxes or customs clearance fees imposed by the destination country.
These charges are not included in the artwork price or shipping costs displayed on this Website.
Any customs duties, import taxes, brokerage fees or similar charges are the sole responsibility of the recipient.
We recommend contacting your local customs office before placing your order if you require information regarding possible import charges.

10. Returns

Every painting sold through this Website is an original work of art.
Because of the unique nature of original artworks, returns or exchanges due to a change of mind are not accepted.
If your artwork arrives damaged during transport, please contact us within 48 hours of delivery and include photographs of the artwork, packaging and shipping label.
Each case will be reviewed individually to determine the most appropriate solution.

11. Availability

As artworks may also be exhibited, reserved or offered through exhibitions and private enquiries, availability cannot always be guaranteed until payment has been completed.
If an artwork has already been sold before payment confirmation, you will receive a full refund.

12. Intellectual Property

All content displayed on this Website, including but not limited to:

• original artworks;

• photographs;

• videos;

• texts;

• product descriptions;

• logos;

• graphic elements;

• website design,

is protected by international copyright and intellectual property laws.

No content may be copied, reproduced, published, distributed, modified or used for commercial purposes without prior written permission.
The purchase of an artwork does not transfer copyright, reproduction rights or licensing rights.
The artist retains all rights to reproduce, publish, license or otherwise use the artwork.

13. Authenticity

Every artwork offered through this Website is created exclusively by Jelena Kundich.
Each original painting is accompanied by a Certificate of Authenticity where applicable.
The natural characteristics of handmade artwork - including texture, brushwork, material variations and surface relief - form part of its originality and authenticity.

14. Limitation of Liability

While every reasonable effort is made to ensure the accuracy of information provided on this Website, we cannot guarantee that all content will always be free from errors or omissions.
To the maximum extent permitted by law, Jelena Kundich Art Studio and SIA "ARTECOM" shall not be liable for any indirect, incidental or consequential damages arising from the use of this Website or the purchase of artworks.
Nothing in these Terms excludes any rights that cannot legally be excluded under applicable law.

18. Force Majeure

Neither Jelena Kundich Art Studio nor SIA "ARTECOM" shall be liable for any delay or failure to fulfil its obligations where such delay or failure results from events beyond reasonable control, including but not limited to natural disasters, pandemics, war, governmental restrictions, customs delays, transportation disruptions, strikes or other unforeseen circumstances.
